These aren’t situations where a dispute letter fixes things. They’re situations where the association has already escalated, or where your rights under federal or state law require someone who can appear on your behalf.
What to look for in an HOA attorney.
- State-specific experience. HOA law is almost entirely governed by state statute. An attorney licensed in Florida won’t know the nuances of California’s Davis-Stirling Act. Make sure they practice in your state.
- Community association law as a focus area. General real estate attorneys often handle HOA cases, but attorneys who specialize in community association law will know the specific procedural levers — and the common board mistakes — far better.
- A clear fee structure upfront. Many HOA disputes can be handled on a flat-fee or limited-scope basis. Ask before assuming you’re signing up for open-ended hourly billing.
- Familiarity with your governing documents. A good HOA attorney will want to read your CC&Rs, bylaws, and rules before giving you an opinion. If they’re willing to advise without reviewing them, look elsewhere.
